Welcome to PlateReview.com. By accessing or using the website located at PlateReview.com, the associated mobile applications, or any related platforms (collectively, the “Websites”), you agree to comply with and be bound by these Terms and Conditions (the “Terms” or “Agreement”). Whether or not you register as a member of PlateReview.com (“Member”), your use of the Websites constitutes acceptance of this Agreement.

If you do not agree with these Terms or the Privacy Policy, you must immediately cease using the Websites and Services. PlateReview.com reserves the right to amend these Terms. Any amendments will become effective only after you have been notified of the changes and provided your explicit consent. Failure to accept updated Terms will result in the termination of your access to the Websites and Services.

Important Notice:

This Agreement contains provisions governing dispute resolution, including binding arbitration and a waiver of class actions. You have the right to opt out of arbitration by providing written notice within 30 days of agreeing to these Terms.

This Agreement is a legally binding electronic contract between you and PlateReview.com. By using the Websites or registering for an account, you agree to be bound by these Terms.

PlateReview.com reserves the right to modify this Agreement. Any modifications will require your explicit consent to become effective.

2. Access and Retention

To access and retain this Agreement, you must have access to the internet and the necessary hardware to view and store online documents. PlateReview.com recommends saving or printing a copy of these Terms for your records.

3. Commercial Use of the Service

If you access the Websites or Services on behalf of a company, organization, or entity (“Subscribing Entity”), you represent and warrant that:

  • You are authorized to bind the Subscribing Entity to this Agreement.
  • You agree to these Terms on behalf of the Subscribing Entity.

4. Prohibited Uses

You agree not to use the Websites or Services in ways that violate these Terms or any applicable laws. Specifically, you agree not to:

  • Post or transmit unlawful, defamatory, obscene, or abusive content.
  • Use automated tools, such as bots or scripts, to scrape data from the Websites without express written permission.
  • Misrepresent your identity or impersonate another individual.
  • Violate intellectual property rights or upload content you do not have the rights to.
  • Distribute viruses, malware, or other harmful components designed to disrupt services.
  • Interfere with the operation or security of the Websites or attempt to bypass any access restrictions.
  • Engage in fraudulent, misleading, or otherwise harmful behavior.

PlateReview.com reserves the right to investigate and take appropriate legal action for violations of these Terms, including account suspension, termination, or reporting to law enforcement.

5. User Account Responsibilities

When creating an account, you must provide accurate and complete information. You are solely responsible for:

  • Maintaining the confidentiality of your username, password, and other account credentials.
  • All activities conducted through your account, regardless of whether you authorized them.
  • Promptly notifying PlateReview.com of any unauthorized access, misuse, or security breaches affecting your account.

PlateReview.com is not liable for losses arising from your failure to secure your account credentials. If you suspect unauthorized access, please contact us immediately.

6. User-Generated Content

PlateReview.com allows users to submit reviews, comments, and other content (“User Content”). By submitting content, you grant PlateReview.com a worldwide, non-exclusive, royalty-free, revocable license to use, reproduce, modify, and display your content in connection with the operation of the Websites. You retain ownership of your content but agree that:

  • Your content must not violate intellectual property, privacy, or other rights of third parties.
  • PlateReview.com may review, remove, or modify content at its discretion, including for compliance with these Terms or applicable laws.
  • You are solely responsible for the legality, accuracy, and quality of your User Content.

7. Intellectual Property Rights

All content on the Websites, including text, graphics, logos, and software, is the property of PlateReview.com or its licensors. You may not:

  • Reproduce, distribute, or create derivative works from Website content without prior written permission.
  • Use content for commercial purposes unless explicitly authorized in writing by PlateReview.com.

8. Modifications to the Service

PlateReview.com reserves the right to modify, suspend, or discontinue any aspect of the Websites or Services at any time, with or without prior notice. PlateReview.com will not be liable for any interruptions, modifications, or discontinuations of the Services.

9. Arbitration and Dispute Resolution

Binding Arbitration: Any disputes arising from these Terms or your use of the Websites will be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. You have the right to opt out of arbitration by providing written notice to PlateReview.com within 30 days of agreeing to these Terms.

Class Action Waiver: You waive the right to participate in class actions or similar proceedings unless prohibited by applicable law.

Arbitration Venue: Arbitration will take place in your state of residence unless otherwise agreed by the parties.

Exceptions: Claims for injunctive relief or disputes involving intellectual property may proceed in court.

10. Limitation of Liability

To the fullest extent permitted by law, PlateReview.com, its affiliates, and its licensors are not liable for:

  • Indirect, incidental, or consequential damages.
  • Loss of profits, data, or goodwill.
  • Issues arising from third-party links or content.

In no event shall PlateReview.com’s liability exceed the greater of $500 or the amount you paid to PlateReview.com in the six months preceding the claim, unless prohibited by applicable law.
